1. Introduction

Welcome to Gleem.AI, a product and service provided by Gleem.AI LTD, situated in Edinburgh, United Kingdom. These Terms govern your use of our websites, mobile applications, Gleem.AI Studio, Gleem Print, avatar and image-generation services, ordering and fulfilment services, and related features, content, and applications (collectively, the “Services”).

2. Acceptance of Terms

By utilizing Gleem.AI, you express your consent to these terms and conditions. Users below the age of 13 are forbidden from using our services. We may alter these terms at any moment. Your ongoing use of Gleem.AI signifies your approval of any modifications to these terms.

3. Privacy Policy

Your privacy is of utmost importance to us. Please refer to our Privacy Policy and Data Deletion for comprehensive information regarding how we gather, employ, and safeguard your personal information.

4. Account Registration and Security

To completely utilize our Services, you might be required to create an account. You agree to provide precise, up-to-date, and comprehensive information during the registration process and to update such information to maintain its accuracy, currency, and completeness. You are solely accountable for safeguarding your password and for any actions performed under your account.

5. Service allowances, offers, and promotional credits

Some Services may include a free-generation allowance, bonus generations, promotional codes, recovery offers, trial access, or testing access (collectively, “Promotional Access”). Promotional Access may be subject to eligibility rules, usage limits, availability periods, account status, and other conditions disclosed with the offer. Unless we expressly state otherwise, Promotional Access:

• is personal to the eligible account, non-transferable, and has no cash value;

• may be claimed only once per person, account, household, device, or campaign, as specified with the offer;

• may be combined with an account's base allowance where the offer states that it is additive;

• does not guarantee that any particular product, style, or generation feature will remain available; and

• may be withheld, cancelled, or reversed where we reasonably identify fraud, automation, duplicate claims, abuse, technical error, or a violation of these Terms.

6. User Conduct and Acceptable Use

You agree to use our Services in accordance with all relevant laws and regulations. You will not upload, post, transmit, or otherwise distribute any content that is unlawful, slanderous, harassing, abusive, fraudulent, obscene, or otherwise offensive.

Acceptable Use & Prohibited Content

You agree not to use Gleem.AI to create, upload, or distribute any content that is illegal, harmful, or violates the rights of others.

(a) Zero Tolerance for Child Exploitation: You are strictly prohibited from using the Service to generate, upload, or share Child Sexual Abuse Material (CSAM) or any content that depicts the sexual exploitation, abuse, or endangerment of minors.

(b) Adult Content: While adult-oriented or "Not Safe For Work" (NSFW) content is not inherently prohibited on Gleem.AI, all such content is subject to strict monitoring. We reserve the right to apply filters or block content that we deem excessive, non-consensual (e.g., non-consensual intimate imagery), or otherwise in violation of our community standards.

Safety Measures and Enforcement

To ensure the safety of our community, Gleem.AI employs automated guardrails and manual monitoring systems.

(a) Input Filtering: Our system proactively blocks prompts or inputs designed to generate explicit content involving minors.

(b) Output Filtering: We monitor AI-generated outputs as an additional layer of security. If a violation is detected in either the input or the output, we reserve the right to terminate the generation process immediately.

(c) Immediate Suspension: Any attempt to circumvent these guardrails or to generate content involving the exploitation of minors will result in an immediate and permanent ban of your account. In such cases, no refunds for remaining credits or subscription fees will be issued.

Legal Reporting & Compliance

Gleem.AI complies with all applicable laws regarding the reporting of illegal activities. In the event that our systems detect content related to child exploitation or CSAM, we will flag the account and associated data for reporting to the National Center for Missing and Exploited Children (NCMEC) and/or relevant law enforcement agencies. We reserve the right to preserve any data necessary to comply with legal obligations or law enforcement requests.

7. Intellectual Property Rights

Unless otherwise stated, all materials, including but not limited to images, illustrations, designs, icons, photographs, and written and other materials that are part of our Services are copyrights, trademarks, and/or other intellectual properties owned by Gleem.AI LTD.

8. User Generated Content

For Gleem.AI to provide you with the Service and related technology, we will process and use the photos you upload to generate Avatars and Images. The photos will only be used for generating avatars and images and not for any other purposes such as training AI models, advertising, or third-party usage (please refer to Privacy Policy to learn more).

You retain all rights to your original photos and the final images generated by the app. By uploading photos, you grant us a temporary license to use the photos for the sole purpose of generating Avatars and Images. The user will hold complete rights, including commercial rights, to the generated images. The user is free to edit, modify, sell, or use these images in any desired manner. We do not claim any ownership rights to the user generated content.

9. AI-generated results and physical products

AI-generated results may vary and may not exactly match uploaded material, previews, or a user's expectations. Users should review generated artwork before ordering a physical product. Screens, previews, crops, materials, printing processes, and production tolerances may cause reasonable differences between a digital preview and a delivered product.

Prices, available products, delivery estimates, taxes, and shipping charges are shown during checkout. An order is accepted only when we confirm acceptance or begin fulfilment. We may reject or cancel an order where a product is unavailable, pricing or catalogue information is materially incorrect, payment is not authorized, or fulfilment is not reasonably possible. Any applicable refund and cancellation rights remain subject to mandatory consumer law.

10. Data Handling and Protection

User photos and associated image data are stored for processing and are deleted once the Gleem.AI account is deleted. We do not view, share, reuse, or use uploaded photos to train AI models beyond the purpose of creating Avatars and generating Images. All photos and image data are deleted from our servers when you decide to delete your account or delete your Avatars. We prioritize your privacy and have implemented measures to ensure the security of your photos and generated images.

11. Limitation of Liability

Gleem.AI LTD is not responsible for any indirect, incidental, consequential, or punitive damages related to the use of our service.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gleem.AI LTD and our employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your misuse of our Services, including but not limited to the violation of these Terms of Service.

13. Termination

Gleem.AI LTD reserves the right, at its sole discretion, to terminate your access to all or part of the Services, with or without notice, for any reason, including, without limitation, breach of these Terms of Service.

14. Dispute Resolution and Governing Law

Any disputes arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, will be referred to and finally resolved by arbitration in accordance with the laws of Scotland.

Privacy Policy

1. Introduction

Your privacy is critically important to us. This Privacy Policy explains how Gleem.AI LTD (“Gleem,” “we,” “us,” or “our”) collects, uses, shares, retains, and protects personal data when you use our websites, mobile applications, Gleem.AI Studio, Gleem Print, avatar and image-generation services, ordering and fulfilment services, and related features (collectively, the “Services”).

2. Information We Collect (Data Definition)

Depending on the Services you use, we may collect:

• Account and contact data: account identifier, email address, authentication information, account status, and communications with support.

• User content: photos, images, prompts, reports, and other material you choose to submit. Uploaded photos are processed to provide the requested avatar or image service and are not used to train our AI models or for advertising unless we separately explain the change and obtain any legally required permission.

• Generation and entitlement data: generation requests and outcomes, lifetime generation usage, free or paid allowances, offer eligibility, offer claims, promotional-code redemption status, administrative or testing access, and records used to prevent duplicate claims or abuse.

• Order and transaction data: products selected, order and purchase identifiers, prices, payment status, delivery and fulfilment status, shipping information, and related customer-service records. Payment-card details may be processed directly by our payment provider rather than stored by Gleem.

• Necessary technical and security data: timestamps, service logs, request identifiers, authentication and security events, error categories, and limited device or network information needed to operate, secure, troubleshoot, and prevent abuse of the Services.

• Product-interaction data: events such as opening an artwork gallery, viewing artwork, starting checkout, closing or abandoning checkout, requesting another avatar, viewing or claiming an offer, and redeeming a promotional code.

• Optional analytics and advertising data: cookie or similar identifiers, analytics session identifiers, device/browser information, and interaction data disclosed to analytics or advertising providers when the required consent or other lawful permission applies.

Account identifiers may be used where needed to enforce account-specific allowances, prevent duplicate claims, and maintain consistent service state.

3. How We Collect Information (Data Collection)

We collect information directly from you, automatically when you use the Services, and from service providers involved in authentication, payments, fulfilment, customer support, security, and analytics. Necessary service records may be created by our servers when you request a generation, claim an offer, redeem a code, start or complete an order, or use a feature whose state must be remembered.

Cookies, local storage, software-development kits, pixels, and similar technologies may also collect information. Technologies used for optional analytics or advertising are activated only in accordance with the consent choices and other requirements applicable to the user.

4. How We Use Your Information (Purpose of Data Use)

We use your information for various purposes such as providing the Service and improving our App, personalizing your experience, understanding how our App is being used, providing customer support, and for administrative purposes like enforcing our Terms of Service. We use photos uploaded by the user solely for the purpose of creating avatars and images within the app. The photos are not used for analyzing and profiling users.

We will use AI technology to process and analyze your photos to identify facial elements and use it to create your digital AI Avatar and generate Images. We won’t use AI technology to identify or authenticate people. All photos and image data associated with your account are deleted permanently from our servers immediately when you either delete the Avatars, delete generated Images, delete your Gleem.AI account or they are deleted automatically after 90 days of inactivity.

5. How We Share Your Information (Data Sharing)

We disclose personal data only as needed for the purposes described in this Policy, including to providers that support hosting, authentication, payments, printing and fulfilment, delivery, customer support, security, and communications; to authorities or other parties where required by law or necessary to protect rights and safety; and in connection with a corporate transaction subject to appropriate safeguards.

We may use PostHog and Google Analytics for optional product analytics. Where analytics consent is required, we do not send product events to these providers unless the user has given that consent. Necessary transactional, entitlement, security, and first-party service records may still be stored by Gleem because they are used to provide, protect, or remember the state of the Services rather than to place optional third-party analytics technologies on the user's device. Events created while optional analytics is disabled should not later be replayed to those analytics providers merely because the user subsequently consents.

If we use Meta or another advertising partner, advertising identifiers and campaign events are disclosed only in accordance with the consent and platform choices applicable to the user. We do not sell or rent personal data to third parties for their own marketing.

6. User Choices and Opt-Outs

You can manage available analytics and advertising choices through the consent controls presented in the Services and, where applicable, through your browser or device settings. Withdrawing optional analytics consent prevents future optional analytics collection or disclosure; it does not erase records that Gleem must retain to complete transactions, preserve generation allowances, prevent fraud, secure the Services, or comply with law.

You may request access to, correction of, or deletion of your personal data, and exercise any other rights available under applicable law, through the account settings or by contacting support@gleem.ai. We may need to verify your identity and may retain limited information where legally permitted or required.

Additionally, you can limit the use of your device's advertising identifier, which is used for interest-based advertising, through your device's system settings. Please follow the instructions provided by your device manufacturer (for iOS, navigate to Settings > Privacy & Security > Tracking; for Android, navigate to Settings > Google > Ads).

7. Children's Privacy

Our App is not intended for users under the age of 13. If you are under 18 you must have your parent or legal guardian’s permission to use the App. We do not knowingly collect any personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.

8. Data Security

We take reasonable measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Our data is stored in a secure data center where standard security measures, such as surveillance, physical security, and security guards, are in place. No external access to the stored data is possible.

9. Photo Data

We do not view, modify, or reuse photos that users upload to the App. Photos are used solely to provide the service and are not shared with third parties. The photos are stored in a secure data center for 90 days since last activity or until the user decides to delete the Avatars, associated images or the Gleem.AI account.

10. International Data Transfers

Our App is available to users around the world. By using our App, you understand and consent to the collection, storage, processing, and transfer of your information to our facilities in the country where our company is located and to those third parties with whom we share it as described in this Privacy Policy.

11. Data Retention and Data Deletion

We retain each category of personal data only for as long as reasonably necessary for the purposes described in this Policy, including providing the Services, maintaining accurate account and transaction records, protecting security, resolving disputes, and meeting legal obligations.

• Uploaded photos and associated image data remain subject to the published 90-day inactivity period or earlier deletion when the relevant avatar, images, or account are deleted, except where preservation is legally required.

• Short-lived first-party product-interaction events should be retained for a defined operational analysis period. Initial period: 90 days. The production configuration and this published Policy must use the same final period.

• Generation usage, entitlement, offer-claim, promotional-redemption, order, payment-status, fulfilment, fraud-prevention, security, and legal records may be retained longer where needed to preserve account state, complete transactions, prevent repeated abuse, comply with accounting or legal duties, or establish and defend legal claims.

• Optional third-party analytics providers retain data according to Gleem's configured retention settings and their applicable terms. Gleem should configure those periods consistently with the purposes and choices described here.

Deletion of an account removes or de-identifies personal data unless retention is necessary for an unfinished transaction, legal compliance, fraud or security prevention, dispute resolution, or another lawful purpose. Where data cannot immediately be removed from backups, it will be isolated from ordinary use and deleted according to the backup lifecycle.

You can delete your Gleem.AI account through the app settings or by contacting us at support@gleem.ai.

12. Updates to This Policy

We may periodically update this Privacy Policy. If we make significant changes, we will notify you through the App or by sending you an email.

14. Legal Compliance and Reporting
